In August 2025, Illinois enacted the Wellness and Oversight for Psychological Resources (WOPR) Act, among the first laws to place strict limits on AI use in mental health therapy. The law bans AI from independently providing therapeutic services and requires licensed human oversight for most applications. 

For HealthTech companies, this isn’t a narrow state-by-state issue. WOPRA is a signal that patient safety, consent, and human oversight will be the foundation for AI in healthcare. Companies that adapt early won’t just avoid penalties, they’ll position themselves as trusted partners in a market that increasingly values responsible innovation.

Breaking Down the WOPR Act: What’s Covered and Who’s Affected

The WOPR Act draws a bright line around what AI can and can’t do in therapy.

  • Banned functions: AI can’t make independent therapeutic decisions, interact directly with clients in therapeutic communication, generate therapeutic recommendations or treatment plans without licensed-clinician review and approval, or detect emotions or mental states.
  • Permitted uses: AI can still assist with administrative support (e.g., scheduling, billing) and supplementary support (e.g., preparing or maintaining client records and therapy notes). If a session is recorded or transcribed, patients must receive written notice and provide consent before AI is used.
  • Consent rules: Patients must receive written notice and give consent before AI is used when a therapeutic session is recorded or transcribed.
  • Enforcement: The Illinois Department of Financial and Professional Regulation can investigate and assess civil penalties up to $10,000 per violation.

Crucially, WOPRA applies to services offered to clients located in Illinois, meaning that even out-of-state companies, like those based in California or New York, need to comply if they serve Illinois residents.
